TERMS AND CONDITIONS

1. General settings

1.1. Mesi24 online store – an online store operating on the Internet address www.mesi24.ee, which belongs to OÜ Artocarpus reg nr. 10247109 (hereinafter also Mesi24).

1.2. Customer – an individual person or company who/that has made a purchase in the Mesi24 online store.

1.3. Seller – a company that sells products in the Mesi24 online store, which is responsible for the delivery and quality of the product.

1.4. In regulating their mutual relations, the contracting parties shall be guided by the Law of Obligations Act and other laws and other legislation of the Republic of Estonia and the agreement provided for in the purchase and sale agreement.

1.5. The Seller has the right to make changes in the E-store services and purchase and sale conditions at any time.

2. Terms of purchase

2.1. The purchase conditions apply to the legal relations arising between the Customer of the Mesi24 online store, the owner of Mesi24 OÜ Artocarpus (hereinafter Mesi24) and the Seller operating in the Mesi24 online store (hereinafter the Seller).

2.2. The purchase conditions have been prepared in good faith and are not in conflict with the applicable laws of the Republic of Estonia.

2.3. Mesi24 reserves the right to change these terms of purchase without notifying third parties of the changes. The amended terms of purchase shall take effect from the moment of their publication.

2.4. The seller has the right to change the products sold in the online store, their descriptions and prices without notifying third parties. These changes shall take effect upon their publication. If the Customer has forwarded the order before the changes take effect, the terms and conditions in force at the time of placing the order shall apply to the Customer, unless otherwise provided by law or these terms and conditions.

2.5. These purchase conditions are the basis for regulating the legal relations between the Mesi24 online store, the Customer and the Seller. By placing an order, the Customer agrees that he has read these purchase conditions and agrees with them.

2.6 All prices are in Euros and include VAT.

2.7. The buyer undertakes to provide true data when completing the order. The seller is not responsible for non-fulfillment of the order due to incorrect data provided by the buyer during the execution of the order or for any consequences thereof.

2.8. The sale takes place only if the Buyer has sent the order via the E-store website and has paid for the order.

2.9. OÜ Artocarpus reserves the right to use previously used but clean cardboard boxes for packaging and shipping the goods.

3. Mesi24 price list

3.1. The prices of the products sold in the Mesi24 online store include VAT and are displayed in Euros and do not include the delivery fee.

3.2. The delivery prices of the goods are based on the order and depend on the delivery method chosen by the Customer.

3.2.1. The price of delivery of products within Estonia via Omniva, Smartpost and DPD courier is 8.00 EUR. The price includes VAT.

3.2.2. Delivery of products within Estonia via SmartPOST, Omniva and DPD parcel machines is 4.00 EUR. The price includes VAT.

3.3. Mesi24 reserves the right to change the delivery methods offered in the online store and to adjust their cost.

4. Ordering and payment of goods

4.1. The order is made on the basis of the Shopping Cart prepared by the Customer.

4.2. The Customer adds products to the shopping cart from the Mesi24 online store.

4.3. In the shopping cart, the Customer can delete products and change their quantities.

4.4. The products included in the shopping cart do not oblige the Customer to pay yet, because the order has not been placed at that time.

4.5. The products added to the Shopping Cart are not reserved for the Customer who created the Shopping Cart, i.e. the products are at the same time for sale to third parties.

4.6. To place an order, the Customer must click on the “Place Purchase” button in the Shopping Cart. The Customer then determines the billing data, delivery method and delivery data. The customer once again verifies the correctness of the order, reads and agrees to the terms of the contract and clicks the “Place order” button.

4.7. The sale takes place only if the Buyer has sent the order via the E-store website and has paid for the order.

5. Delivery and handover of goods

5.1. The seller will ship the goods either on the day the payment is received or on the next two (2) business days.

5.2. The goods will be sent to the buyer using either the Omniva, Smartpost or DPD service and in accordance with the valid price lists.

5.3. The seller is not responsible for delays caused by the transport service provider.

5.4. The customer can choose between three (3) different delivery methods.

5.4.1. Delivery of products via Omniva parcel machines.

5.4.2. Delivery of products via Smartpost parcel machines.

5.4.2. 5.4.2. Delivery of products via DPD parcel machines.

6. Order cancellation and refund

6.1. The Customer can cancel the order at any time before the Order is “Posted”. To cancel the order, a free-form message must be sent to the e-mail address martin@mesi24.ee. In this case, Mesi24 will refund the money to the Customer within 14 days of receiving the order cancellation notice.

6.2. If the order is in the “Posted” status, it is not possible to cancel the order. In this case, the Customer must follow the rules of returning the goods.

6.3. Mesi24 has the right to cancel the order unilaterally if the ordered goods are out of stock for some reason or cannot be delivered for some other reason. In this case, the Seller will contact the Customer and offer alternative products. If alternative products are not suitable for the Customer, Mesi24 will return the money paid for the order to the Customer’s bank account within two (2) days.

7. Return of goods

7.1. Pursuant to the laws in force in Estonia, the Customer has the right to withdraw from the contract within 14 days from the moment of receipt of the goods. Upon forwarding the withdrawal application, the Customer must return the goods.

7.2. Return of the goods is allowed only if the invoice for the order has been preserved, the packaging of the product, the product has not been damaged (incl. The product has not been opened) or used, dirty or worn. The Seller will assess the suitability of returning the product.

7.3. Upon returning the goods, Mesi24 will return the money paid for the order (excluding transport) to the Customer’s bank account as soon as possible, but not later than within 30 days of receipt of the withdrawal application and the goods by the trader.

7.4. The return of the Goods to the Seller is at the Customer’s own expense and Mesi24 does not reimburse the costs related to the return of the Goods.

7.5. In case of exchange of the goods, the Customer returns the goods to the Seller at his own expense.

7.6. If the goods are damaged, which were not identified by external inspection and which did not occur when the package was opened, or if the goods are not what the Customer ordered, the return cost is borne by Mesi24.

7.7. If the Customer decides to exercise the right of withdrawal, he is obliged to open the product packaging carefully and without damaging it. If it turns out that the product has been damaged due to the Customer’s wrongful behavior or improper use, Mesi24 has the right to offset the decrease in the value of the product from the amount to be returned to the Customer.

8. Submitting a claim and returning non-compliant products.

8.1. All products for sale are subject to the guarantees and return procedure prescribed by the laws of the Republic of Estonia.

8.2. The customer has the right to return the goods purchased from our e-shop within 14 (fourteen) calendar days from receipt. The returned goods must not be used, damaged and the packaging must not be open.

8.3. Honey, mixtures of honey and other apiculture products in open packages are not subject to return.

8.4. Mesi24 guarantees the confidentiality of the personal data of the users of the Internet portal and does not sell / transfer / mediate the personal and contact data of the users to third parties, except in case of special agreements (when announcing the winners of possible campaigns)

9. Force majeure, liability and other conditions

9.1. Mesi24, the Seller and the Customer shall be liable for the damage caused as a result of the violation of these terms and conditions to the extent and in the cases provided by the laws of the Republic of Estonia.

9.2. The parties shall not be liable to the other party and its conduct shall not be deemed to be in breach of these terms and conditions due to delay or non-performance of any obligation, unless the cause of such action is beyond the control of that party (force majeure).

9.3. Mesi24 and the Seller do not compensate the Customer for moral damage that may occur by changing these terms, prices, delivery times and other terms within these terms.

9.4. Mesi24 uses the Customer’s personal data only in accordance with the procedure prescribed for fulfilling the order.

9.5. Mesi24 reserves the right to send newsletters to the Customer’s e-mail address if the Customer has expressed this request during registration or in account management.

9.6. In matters not regulated in these terms and conditions, the Customer, the Seller and Mesi24 shall be guided by the legislation in force in the Republic of Estonia and other acts regulating the relations between the parties.

9.7. In case of disagreement, the parties shall endeavor to resolve them by negotiation. If it is impossible, the Customer has the right to apply to a court or the Consumer Protection Board to protect their rights.
